What Happens When You Call?

LMB logo

You describe what happened, and you get an honest answer about whether there is a case.

The conversation usually covers four things: what happened and when, what medical treatment you have had, what the insurance company has said so far, and what you need most right now. It takes about fifteen minutes.

If there is a claim worth bringing, we explain the next steps and roughly how long they take. If there is not, we tell you that rather than sign you up. Either way, nothing is filed and nobody is contacted without your agreement.

Which Office Should You Contact?

The one closest to you. Each office is staffed and each has its own local line.

If travel is difficult, say so when you call. We meet clients at home, in the hospital, and at rehabilitation facilities, and a great deal of work is handled by phone and video.

What Should You Have Ready?

Whatever you have. Nothing on this list is required for a first conversation.

Helpful items include the crash or incident report number, the name of the insurance company that has contacted you, photographs from the scene, the names of any doctors you have seen, and your own auto insurance declarations page. That last one matters more than people expect, because uninsured motorist coverage on your own policy is frequently the largest source of recovery.

If you have already received a letter or an offer from an insurer, bring it. Reviewing an offer before you respond is free and it takes very little time.

What Does a Consultation Cost?

Nothing, and there is no obligation attached to it.

The firm works on contingency, which means the fee comes out of a recovery rather than out of your pocket, and you don’t pay until and unless we win your case. Case costs, including records, outside consultants, and filing fees, are carried by the firm while a case is pending.

Who Will You Actually Speak With?

A partner. Kennedy Legler, Edward Murphy, and Alyson Battaglia all still handle cases personally, and clients here are not passed to a case manager and reintroduced to a lawyer at mediation.

You can read each partner’s background on our team page and verify their Florida Bar records through The Florida Bar. More about the firm’s history and how it works is on our about page.

What Kinds of Cases Does the Firm Take?

LMB favicon

Injury and workers’ compensation matters, with most of the caseload coming from vehicle collisions and property owner negligence.

That includes car, truck, motorcycle, pedestrian, bicycle, and rideshare crashes; slip and fall, trip and fall, negligent security, and dog bite claims; catastrophic injuries including brain and spinal cord trauma; boating and personal watercraft incidents; wrongful death claims; medical negligence; and workers’ compensation matters. The personal injury section covers each area, and there are location pages for Sarasota, Lakewood Ranch, and Venice.

If your situation is not on that list, call anyway. Part of a first conversation is telling you honestly whether this is the right firm, and if it is not, pointing you somewhere better.

Why Do People Call a Local Firm Instead of a Statewide One?

Because a case in Manatee or Sarasota County is decided by people who work here.

Suits filed in these counties go to the Twelfth Judicial Circuit, with courthouses in Bradenton, Sarasota, and Venice. The judges, the defense bar, the adjusters covering this territory, and the physicians who treat injured people locally are all familiar to a firm that has practiced here since 1989. That familiarity affects what a claim is worth and how quickly it moves.

It also affects the ordinary parts. We know which providers will treat someone while a claim is pending, and how the seasonal population swing changes traffic on the roads where these crashes happen.

Is There a Deadline to Worry About?

Usually two years, and sometimes much less.

Most Florida negligence claims must be filed within two years of the injury, under section 95.11 of the Florida Statutes. Claims involving a city, county, or state agency require written notice well before that. In motor vehicle cases, personal injury protection benefits are lost entirely unless medical care begins within 14 days of the crash.

Evidence runs on an even shorter clock. Surveillance video is often overwritten within a month, vehicles get repaired, and witnesses move away. That is the reason to call early rather than the deadline itself.

Contact Form

Send a message and someone will respond. Include your name, a phone number and email where we can reach you, where and when the injury happened, and a short description of what occurred.

Please do not include sensitive medical details in a web form. Submitting the form does not create an attorney-client relationship, and that relationship begins only once a written agreement is signed.

Common Questions Before You Call

Do I have to come into an office to start?

No. Most cases begin with a phone call, and many clients never need to visit an office at all. Where an in-person meeting helps, we can come to you.

Will calling commit me to anything?

No. The consultation is free, carries no obligation, and does not require you to sign anything. Many callers simply want to know whether they should be worried about a deadline or an offer.

Can you help if my case is already with another firm?

Yes. Clients may change counsel, and it does not usually increase the total fee, since the two firms divide a single contingency fee. A second opinion costs nothing.

What if I am not sure whether I even have a case?

That is the most common reason people call. Describing what happened costs nothing and takes fifteen minutes, and getting a clear answer is better than wondering about it for a year.
