What Should I Do if I Have a Motorcycle Accident?

If you’ve been involved in a motorcycle accident, here are the most important steps you should take:

  • Seek medical attention: The first thing you should do is seek medical attention for yourself or anyone else who was injured in the accident. Call 911 or go to the nearest emergency room if necessary.

NOTE: Remember, Personal Injury Protection (PIP) insurance is not required for motorcycle riders in Florida!!!

  • In Florida, PIP insurance or “no fault” is a type of insurance that covers medical expenses and (sometimes) lost wages in the event of an accident, but it is not applicable to motorcycle riders. Instead, Florida law requires that all motorcycle riders have a minimum of $10,000 in medical insurance coverage to cover injuries sustained in a motorcycle accident. This insurance can be obtained through a health insurance policy or a separate motorcycle insurance policy that includes medical coverage. It’s important to note that while motorcycle riders in Florida are not required to carry PIP insurance, they may still be held liable for damages and injuries resulting from an accident. As a result, it’s important for motorcycle riders to have adequate insurance coverage to protect themselves and others in the event of an accident.
  • Move to a safe location: If possible, move your motorcycle and yourself to a safe location away from traffic. Turn on your hazard lights to warn other drivers.
  • Call the police! Even if the accident seems minor! The police will create an accident report which can be important later for insurance and legal purposes.
  • If no Police Report is Done (Not Recommended): Make Sure to Exchange information! Get the contact and insurance information of all parties involved in the accident, including the driver of the other vehicle and any witnesses. Take pictures of the accident scene/intersection, damage to any vehicles and your motorcycle, and any injuries.
  • Contact your insurance company: Report the accident to your insurance company as soon as possible.

  • Keep records: Keep a record of all medical treatments, expenses, and other related costs. This can help you with insurance claims or a potential lawsuit.

Are Helmets Required? In Florida, motorcycle riders who are over the age of 21 and have at least $10,000 in medical insurance coverage are not required to wear a helmet. Even though wearing a helmet is not required under Florida law, it is HIGHLY encouraged as it can provide important protection in the event of an accident.
