Do You Need a Personal Injury Lawyer in Bradenton?

If you were hurt badly enough to miss work, need ongoing treatment, or were told the crash was partly your fault, hiring a lawyer usually changes the outcome. Insurance companies evaluate represented claims differently than unrepresented ones, and once you sign a release, the claim is closed for good.
Some situations make legal help close to essential:
You were hospitalized, had surgery, or were told you may need one later. The at-fault driver’s insurer is disputing who caused the crash. Your own carrier is questioning your medical treatment. Or the offer on the table does not cover the bills you already have, let alone the ones coming.
If none of that applies and you walked away with a sore neck that resolved in a week, you may not need anyone. We will tell you that on the phone rather than sign you up.
There is also a timing element people underestimate. The window to preserve evidence is short, and it closes while you are still in treatment and least able to think about it. Intersection camera footage, the trucking company’s electronic logs, the store’s incident report, and the vessel damage on a boat that is about to be repaired all disappear on their own schedule, not yours.

How Much Does a Bradenton Personal Injury Attorney Cost?
Nothing up front. We work on contingency, which means our fee comes out of a recovery rather than out of your pocket, and you don’t pay until and unless we win your case. The first consultation is free and carries no obligation.
Contingency matters more than most people realize. It means the firm absorbs the cost of records, experts, and filing fees while the case is pending. It also means we only take cases we believe in, because we are spending our own money to build them.
How Long Do You Have to File an Injury Claim in Florida?

Most Florida negligence claims must be filed within two years of the date of the injury. That deadline comes from section 95.11 of the Florida Statutes, and wrongful death claims carry the same two-year window.
Two years sounds generous. It rarely is. Crash video gets overwritten, store surveillance recycles in weeks, witnesses move, and a serious injury case often needs a year of treatment before anyone can value it honestly. Waiting also gives the insurer room to argue your injuries came from something else.
Different rules apply to claims against a city, county, or state agency, which require written notice well before any lawsuit. If a government vehicle or public property is involved, timing gets tight quickly.
Not sure how much time you have left? Call +1 (941) 748-5599 and we will tell you.
What Is PIP, and Why Does It Run Out So Fast?
Personal Injury Protection, usually called PIP, is the $10,000 in medical and disability benefits every Florida driver carries under section 627.736 of the Florida Statutes. It pays regardless of who caused the crash, and for anyone with a real injury it is gone quickly.
Two rules trip people up. You must receive initial care within 14 days of the crash or PIP pays nothing at all. And unless a qualified provider documents an emergency medical condition, your benefits are capped at $2,500 instead of $10,000.
One ambulance ride and a night at a Bradenton emergency room can consume most of that. Everything after it comes from the at-fault driver’s liability coverage, your own uninsured motorist coverage, or a health insurer that will want to be paid back from your settlement. Sorting out which bucket pays which bill is a large part of what we do before a single dollar reaches you.
When the Insurance Company Blames You for Your Own Accident
You can still recover in Florida as long as you are not found more than 50 percent responsible. Under section 768.81 of the Florida Statutes, your damages are reduced by your share of fault, and a party found more than 50 percent at fault recovers nothing.
That rule is why adjusters push fault onto injured people so aggressively. Shifting you from 20 percent to 51 percent does not trim the claim, it erases it. Recorded statements, casual apologies at the scene, and social media posts all get used to build that argument.
Our role is to pin fault where the evidence puts it. That means crash reconstruction where it is warranted, scene photographs before conditions change, and the physical evidence that outlasts everyone’s memory of the day.
Comparative fault also gets argued in ways that have nothing to do with the collision itself. Insurers raise seat belt use, a gap in treatment, a prior back complaint, or the claim that you should have seen the hazard on the floor. Each of those is answerable, but only if someone answers it in writing before the file hardens.
What Can You Recover in a Bradenton Injury Claim?
Florida injury claims cover economic losses you can document and human losses that no receipt captures. Both belong in the number, and insurers routinely pay the first while discounting the second.
Economic damages include emergency and hospital care, surgery, therapy, prescriptions, assistive equipment, mileage to appointments, lost wages, and reduced earning capacity when you cannot go back to the work you did before. Future medical care counts as well, and proving it takes physician testimony rather than a guess.
Non economic damages cover pain, permanent impairment, scarring, and the parts of your life the injury took away. A roofer who cannot climb, a grandmother who cannot lift a toddler, and a boater who cannot get back on the water have all lost something real.
Insurance software valuing your claim does not know any of that unless someone puts it in the file. Building that record, with treating physicians, employers, and the people who see you every day, is where cases gain or lose most of their value.

From the First Call to Resolution: How a Bradenton Case Moves

Most cases move through four stages: treatment, demand, negotiation, and, when the number is not fair, suit. Roughly nine out of ten resolve without a trial, but the ones that settle well are the ones the other side believes will be tried.
We do not send a demand while you are still actively treating. Valuing a claim before your doctors know where you will end up almost always costs money. Once your condition stabilizes, we assemble the medical record, wage documentation, and future care evidence, then put a number on it.
If suit becomes necessary, Manatee County civil cases are filed in the Twelfth Judicial Circuit at the judicial center on Manatee Avenue West, a few minutes from our office. Cases arising on the Sarasota County side of Lakewood Ranch are filed in Sarasota. Knowing which judges handle these dockets, and how local juries have responded to similar injuries, shapes what a case is worth long before anyone picks a jury.
Filing suit does not mean a trial is coming. It means the case moves onto a schedule the insurer cannot control, with depositions, records subpoenas, and deadlines that force decisions. A large share of claims that stalled in negotiation settle within months of a lawsuit being served, because the calculation on the other side changes.
Throughout all of it, you deal with the partner handling your file. Nobody at this firm passes a client to a case manager and reappears at the settlement conference.
Why Have Southwest Florida Families Called This Firm Since 1989?
Because the same three attorneys have been here the whole time. Kennedy Legler, Edward Murphy, and Alyson Battaglia all still practice, and the client who hires this firm works with a partner rather than a rotating file handler.
Longevity in one market is worth something concrete. Thirty five years in Manatee and Sarasota counties means the firm has appeared before these judges, dealt with these adjusters, and worked with the treating physicians and rehabilitation providers our clients actually see. It also means we are still here when a case takes three years, which serious ones sometimes do.
It shows up in smaller ways too. We know which Bradenton intersections generate the crashes we see over and over, how the seasonal population swing on Manatee Avenue and along the Cortez corridor changes traffic between February and August, and which orthopedic and neurology practices in Manatee County will treat an injured person while a claim is pending. That is local knowledge you cannot import from a call center in another city.
You can read what former clients have said on our reviews page and see the kinds of matters we handle on our case results page.
We also represent injured people in Sarasota, Lakewood Ranch, and Venice, and the Sarasota personal injury attorneys page covers that market specifically.
Questions Bradenton Clients Ask Before They Call
Should I talk to the other driver’s insurance company before I hire a lawyer?
You are not required to give the other driver’s insurer a recorded statement, and in most cases you should not give one before speaking with a lawyer. You do have a duty to cooperate with your own carrier. The safest approach is to report the crash to your insurer, decline the recorded statement request from the other side, and get advice before you say anything that can be quoted back to you months later.
What if the person who hit me had no insurance?
You may still have coverage through your own policy. Uninsured and underinsured motorist coverage steps into the at-fault driver’s shoes, and many Florida drivers carry it without knowing. Bring your declarations page to the consultation and we will read it with you. Household policies, employer vehicles, and resident relatives can all open doors that are easy to miss.
Can I switch lawyers if I already signed with another firm?
Yes. Clients have the right to change counsel, and doing so does not usually increase the total fee. The two firms divide the single contingency fee between them, so you are not charged twice. If you are unhappy with how your case is being handled, a second opinion costs nothing.
How long will my case take?
Straightforward claims often resolve in six to twelve months once treatment ends. Cases involving surgery, disputed liability, or a lawsuit typically run longer, sometimes two years or more. The honest answer is that the timeline follows your medical recovery, because no one can value a claim before your doctors can describe where you will end up.
Do I have to come to your office?
No. We meet clients at home, at the hospital, or at a rehabilitation facility when travel is hard, and we handle a great deal by phone and video. If getting to Manatee Avenue is not realistic right now, say so when you call.
